(AP) ? Kiss frontman Gene Simmons made a surprise appearance at a Sioux Falls benefit concert Saturday, where he spoke of music's power to positively shape children's lives.

Simmons's appearance came on the final day of a week of concerts to benefit the music academy for Sioux Falls Boys & Girls Clubs members.

"This is about kids. We've had our chance. We've got to give them a chance. Anything that gets them off the street is a good thing," Simmons said.

Music, Simmons said, is self-empowering.

"It doesn't matter if you become a star. If you don't believe in yourself and get up on stage, everybody is watching. You can feel the power ... and it helps you get through life, especially when you're impressionable."

He said getting involved in music ? whether it's learning to play an instrument or sing karaoke ? improves social skills, too.

Motley Crue singer Vince Neil was also at Saturday's show, and he, too, expounded on the positive benefits of music.

"Say you finish your first song, it could be 'Mary Had a Little Lamb,' it doesn't matter, but at least it's something you've played," Neil said. "And I think for kids, they could go into a whole other direction because they accomplished something."

Neil said he was 10 when he first started taking guitar lessons.

"I was terrible," he said laughing. "That's why I'm not a guitarist. I went into the other direction."

APNewsBreak: Gas trade group seeks fracking probe

ALBANY, N.Y. (AP) ? A formal complaint filed with New York's lobbying board asks it to investigate whether Artists Against Fracking, a group that includes Yoko Ono and other A-List celebrities, is violating the state's lobbying law, according to the document obtained by The Associated Press.

The Independent Oil & Gas Association, an industry group that supports gas drilling, filed the complaint Tuesday with the state's Joint Commission on Public Ethics.

The complaint is based on an AP story that found that Artists Against Fracking and its members, including Ono, her son Sean Lennon, actors Mark Ruffalo and Robert De Niro and others, aren't registered as lobbyists and therefore didn't disclose their spending in opposition to hydraulic fracturing, or fracking, to remove gas from underground deposits.

"The public has been unable to learn how much money is being spent on this effort, what it is being spent on, and who is funding the effort," said Brad Gill, executive director of the Independent Oil & Gas Association of New York. "I understand the power of celebrity that this organization has brought to the public discussion over natural gas development, but I do not understand why this organization is not being required to follow the state's lobbying law."

The group confirmed it filed the complaint but didn't comment further.

Artists Against Fracking, formed by Ono and Lennon, says its activities are protected as free speech. The group was created last year amid the Cuomo administration's review to determine whether to allow hydraulic fracturing to remove gas from vast underground shale formations in southern and central New York.

Gov. Andrew Cuomo continues his review as public opinion has shifted from initial support based on the promise of jobs and tax revenue from drilling in economically depressed upstate New York to mixed feelings because of concerns over potential environmental and health effects.

Seven months after Artists Against Fracking was formed, the Quinnipiac University Polling Institute on March 20 found that New York voters were for the first time opposed to fracking, 46 percent to 39 percent.

"There's no doubt the celebrities had an effect," Quinnipiac pollster Maurice Carroll said. "As far as I can tell, they made all the difference."

A spokesman for Artists Against Fracking said the group and its individual members don't have to register as lobbyists.

"As private citizens, Yoko and Sean are not required to register as lobbyists when they use their own money to express an opinion and there's also no lobbying requirement when you are engaged in a public comment period by a state agency," spokesman David Fenton said.

"If the situation changes then, of course, Artists Against Fracking will consider registering," Fenton said. "Up to now, there has been no violation because they are entitled to do this as private citizens with their own money."

On its website, the group implores readers: "Tell Governor Cuomo: Don't Frack New York." Celebrities supporting the group have led rallies and performed in the song "Don't Frack My Mother," also carried on the Internet.

Ethics commission spokesman John Milgrim didn't immediately respond to a request for comment on Friday. By law, the commission doesn't confirm or deny pending investigations.

New York's former lobbying regulator, attorney David Grandeau, said he believed the group and the supporting artists, including musicians Paul McCartney and Lady Gaga and actress Anne Hathaway, should be registered and required to disclose details on their efforts to spur public opposition to gas drilling.

"When you are advocating for the passage or defeat of legislation or proposed legislation and spend more than $5,000, you are required to register," Grandeau said Friday. "Just because you are a celebrity doesn't mean that lobbing laws don't apply to you. Your celebrity status does not protect you in Albany."

Hip-hop mogul Russell Simmons and developer Donald Trump are among the high-profile figures who clashed with the commission when Grandeau was regulator. The biggest penalty for failure to follow the lobbying law resulted in a $250,000 fine against Trump and others over casinos in 2000.

(AP) ? Pope Francis reached out in friendship to "so many Muslim brothers and sisters" during a Good Friday procession dedicated to the suffering of Christians from terrorism, war and religious fanaticism in the Middle East.

The new pontiff, who has rankled traditionalists by rejecting many trappings of his office, mostly stuck to the traditional script during the nighttime Way of the Cross procession at Rome's Colosseum, one of the most dramatic rituals of Holy Week.

With torches lighting the way, the faithful carried a cross to different stations, where meditations and prayers were read out recalling the final hours of Jesus' life and his crucifixion.

This year, the prayers were composed by young Lebanese, and many recalled the plight of minority Christians in the region, where wars have forced thousands to flee their homelands. The meditations called for an end to "violent fundamentalism," terrorism and the "wars and violence which in our days devastate various countries in the Middle East."

Francis, who became pope just over two weeks ago, chose, however, to stress Christians' positive relations with Muslims in the region in his brief comments at the end of the ceremony.

Standing on a platform overlooking the procession route, Francis recalled Benedict XVI's 2012 visit to Lebanon when "we saw the beauty and the strong bond of communion joining Christians together in that land and the friendship of our Muslim brothers and sisters and so many others."

"That occasion was a sign to the Middle East and to the whole world, a sign of hope," he said.

Friday's outreach followed Francis' eyebrow-raising gesture a day earlier, when he washed and kissed the feet of two women, one a Muslim, in the Holy Thursday ritual that commemorates Jesus' washing of his apostles' feet during the Last Supper before his crucifixion.

Breaking with tradition, Francis performed the ritual on 12 inmates at a juvenile detention center, rather than in Rome's grand St. John Lateran basilica, where in the past, 12 priests have been chosen to represent Jesus' disciples.

Before he became pope, the former Cardinal Jorge Mario Bergoglio long cultivated warm relations with Muslim leaders in his native Argentina. In one of his first speeches as pope, he called for the church and the West in general to "intensify" relations with the Muslim world.

The Vatican's relations with Islam hit several bumps during Benedict XVI's papacy, when he outraged Muslims with a 2006 speech quoting a Byzantine emperor as saying some of Prophet Muhammad's teachings were "evil and inhuman." And in 2011, the pre-eminent institute of Islamic learning in the Sunni Muslim world, Cairo's Al-Azhar institute, froze dialogue with the Vatican to protest Benedict's call for greater protection of Christians in Egypt.

However, Francis' past outreach to the Muslim community in Argentina seems to have changed that. Al-Azhar's chief imam, Sheik Ahmed el-Tayyib, sent a message of congratulations to Francis on his election and said he hoped for cooperation.

The Vatican's efforts to reconcile with the Islamic world have not been welcomed by all. Italy's most famous Muslim convert to Catholicism, Magdi Allam, announced last week he was leaving the church because of its "soft" stance on Islam. Allam was baptized by Benedict XVI in 2008 during the high-profile Easter Vigil service when the pope traditionally baptizes a handful of adults. There has been no Vatican comment on his about-face.

Thousands of people packed the Colosseum and surrounding areas for the nighttime procession, holding candles wrapped in paper globes as Francis sat in silent prayer as a giant torch-lit crucifix twinkled nearby. Some in the crowd had Lebanese flags around their shoulders in an indication of the special role Lebanese faithful played in this year's procession.

Lebanon has the largest percentage of Christians in the Middle East ? nearly 40 percent of the country's 4 million people, with Maronite Catholics the largest sect. As civil war has raged in neighboring Syria, Lebanon's Christian community has been divided between supporters and opponents of Syrian President Bashar Assad.

Overall, Christians in the Middle East have been uneasy as the Arab Spring has led to the strengthening of Islamist groups in most countries that have experienced uprisings. Thousands of Christians have fled the region ? a phenomenon that the Vatican has lamented, given Christianity's roots in the Holy Land.

"How sad it is to see this blessed land suffer in its children, who relentlessly tear one another to pieces and die!" said one of the Good Friday meditations. "It seems that nothing can overcome evil, terrorism, murder and hatred."

Francis picked up on that message, saying Christ's death on the cross is "the answer which Christians offer in the face of evil, the evil that continues to work in us and around us."

"Christians must respond to evil with good, taking the cross upon themselves as Jesus did," he said.

At the end of the ceremony, a male choir sang a haunting Arabic hymn, a reflection of the Eastern rite influence that infused the ceremony.

On Saturday, Francis presides over the solemn Easter Vigil ceremony in St. Peter's Basilica and on Sunday, he celebrates Easter Mass and delivers an important speech. Usually the pope also issues Easter greetings in dozens of languages.

In his two weeks as pope, Francis' discomfort with speaking in any language other than Italian has become apparent. The Vatican spokesman, the Rev. Federico Lombardi, said Friday "we'll have to see" what Francis does with the multilingual greetings.

The Good Friday procession was conducted entirely in Italian, whereas in years past the core elements recounting what happens at each station would be recited in a variety of languages.

Cypriot banks set to reopen after 12 days -- but customers can only withdraw $383 each

Banks on the tax haven of Cyprus opened Thursday for the first time in 12 days amid the island's continuing financial crisis.

Strict limits on the amount of money that could be withdrawn have been imposed ? people will be able to withdraw 300 euros ($383) a day and no checks will be cashed ? amid fears of a run on the banks.

Account holders showed up hours before the banks were due to open to get in line.

Early indications were that there was no mass rush to withdraw cash, with just 13 people waiting outside one large Bank of Cyprus branch on the island as it opened at noon local time (6 a.m. ET). They were surrounded by a scrum of journalists.

Previously people could only withdraw 100 euros (about $127) a day from the country's two biggest banks from ATMs.?Most who lined up for the opening were elderly people and those without ATM cards.?

However a small crowd of people did press against the doors of a branch of Laiki Bank, which is being liquidated. CNBC sources estimate those with more than 100,000 euros (about $128,000) in accounts in Laiki Bank could lose 40 to 70 percent of their deposits.

Deposits above 100,000 euros with the Bank of Cyprus will be frozen and 40 percent of each account will be converted into bank stock. Accounts in both banks with balances under 100,000 euros will be fully protected.

A previous proposal to take less from all bank accounts?was vetoed by the Cypriot parliament.

The country is seeking to meet the terms of a bailout from the European Union of 10 billion euros ($12.9 billion) and, in order to raise enough funds to meet strict conditions imposed by the EU, it is preparing to take money from bank accounts.

Ahead of the banks? reopening, money was flown into the island and guards were seen delivering cash to banks in armored vehicles.

The banks were due to close at 6 p.m. local time (12 p.m. ET).

There was some relief on the island that the banks were finally opening again, but this was mixed with fear about what could happen.

The banks in Cyprus are set to reopen after days of being closed as a measure to prevent a run on deposits during the country's financial crisis. Millions in cash is on the move tonight as people camped out in expectation. ITV's Emma Murphy reports

'Slow death'
Yorgos Georgiou, who owns a dry cleaning business in Nicosia, told Reuters that "finally people's mood will be lifted and we can start to trust the system again."

But he added: "I'm worried about the poor kids working in the cashiers today, because people might vent their anger at them. You can't predict how people will react after so many days."

Kostas Nikolaou, a 60-year-old retiree, told Reuters that the uncertainty of the past two weeks had been "like a slow death."

"How can they tell you that you can't access your own money in the bank? It's our money, we are entitled to it,? he added.

The country?s president, Nicos Anastasiades, has described the bailout deal as ?painful? but essential.

However, Nobel laureate economist Christopher Pissarides said it was ?extremely unfair to the little guy.?

?For the first time in the euro zone, depositors are (being) asked to bail out failing banks," he said. "Now that used to be the case in the 1930s, especially United States (and) caused big bank runs. It has been decided since then that we shouldn?t allow that to happen again.?

As Cyprus celebrates its Independence Day, the ?government is defending the last-minute bailout deal it's negotiated with the European Union. This means shutting down the country's second biggest bank, with big savers facing ?losses. ?ITV's Emma Murphy reports.

Among other controls, the island's central bank will review all commercial transactions over 5,000 euros and scrutinize transactions over 200,000 euros on an individual basis, Reuters reported. People leaving Cyprus can take only 1,000 euros with them. An earlier draft of the decree had put the figure at 3,000.

Reuters summed up the situation facing the island:

With just 860,000 people, Cyprus has about 68 billion euros in its banks - a vastly outsized financial system that attracted deposits from foreigners as an offshore haven but foundered after investments in neighboring Greece went sour.

The European Union and International Monetary Fund concluded that Cyprus could not afford a rescue unless it imposed losses on depositors, seen as anathema in previous euro zone bailouts.?The bailout looks set to push Cyprus deeper into an economic slump, shrink the banking sector and cost thousands of jobs.

European leaders said the bailout deal averted a chaotic national bankruptcy that might have forced Cyprus out of the euro.

Many Cypriots say the deal was foisted upon them by Cyprus's partners in the 17-nation euro zone within the European Union, and some have taken to the streets to vent their frustration.

For most users, Game Center is all about matching up with friends and competing for rankings and checking out leaderboards. It's not much fun though if you don't have anyone to play against. If you've found a particularly cool multiplayer game in the App Store that you think a friend would like, Game Center makes it easy to tell friends about it complete with an App Store link for them to check it out.

Here's how:

  1. Launch the Game Center appfrom the Home screen of your iPhone or iPad.
  2. Tap on the Games tab along the bottom navigation.
  3. Find the game that you'd like to share with a friend in your list of games and tap on it.
  4. Scroll all the way to the bottom and tap on the Tell a friend button.
  5. You'll now be shown an auto-filled email with information about the game. Just type in the email of the person you'd like to share it with and tap Send.

That's all there is to it. Your friend will receive the email and be able to directly view the game on the App Store and choose to download or buy it.

BlackBerry subscriber bleed turns into an arterial gush

BlackBerry?s (BBRY) fourth-quarter earnings were?a bundle of such extreme opposites that they literally stunned Wall Street.?Many expected huge price swings, but as of 10:27 a.m. on Thursday, the share price is up 1.8%. Investors are having trouble figuring out whether to giggle with glee over the big Z10 shipment number or shriek with horror over the massive subscriber loss.

This quarter crystallized the theme we wrote about last week: the low-end product range of BlackBerry is collapsing. Despite shipping 1 million Z10 devices ?many analysts expected shipments in the 300,000 to 500,000 range ? the overall device volume was just 6 million, or 900,000 units below consensus. At the same time, the subscriber base situation is worse than practically anyone expected: 2 million subscribers were added in the August quarter, 1 million subscribers were lost in the November quarter and 3 million subscribers were lost in the February quarter.

The trend is clear. And dreadful. It implies that the emerging market softness is deepening rapidly. The $200 Android QWERTY models from Samsung (005930), Huawei, ZTE and other Asian vendors are tearing into the connective tissue of BlackBerry?s global empire. BlackBerry is now losing about 3.8% of its sub base over a three-month period. The entire ecosystem in countries like South Africa and Philippines is built on high market penetration; that is the lifeblood of BBM. Allowing Android and iOS platforms to gain share means risking a runaway WhatsApp contagion and the loss of relevance in the messaging wars.

BlackBerry turned a surprise profit during the quarter because the ratio of high-end Z10 to low-end Curve phones was much higher than expected. But this happened both because the Z10 shipment was bigger than anticipated, while the low-end device volume was smaller than expected. This does not need to be a problem if BlackBerry starts shipping sub-$300 devices in a month or two.

But if the company is six months from shipping the new Curve line the blood could really flow over this summer. The same happens if the price of the new Curve devices is too high: Markets from Brazil to Nigeria to Malaysia are clearly transitioning to smartphones that are priced at $250 or under. If BlackBerry miscalculates the premium it can command in emerging markets, it?s lights out in Waterloo.

What about the May quarter? The combination of 1 million unit Z10 shipment and 3 million unit subscriber loss was a chilling demonstration of how hard it is for BlackBerry to succeed with luxury devices alone. BlackBerry may not need the U.S. market anymore,?but getting cheap new devices to emerging markets is absolutely vital. Global smartphone sales grew at roughly 35% annualized pace during the February quarter, yet BlackBerry?s sales volume is still shrinking faster than even the bearish Wall Street consensus expected.

This is coming down to a race between how fast the BlackBerry subscriber base is eroding and when the new low-end models finally launch.

Charles Barkley might have said that Twitter is for "losers"?in the past, but the NBA star turned announcer might be changing his tune shortly after taking on the role of social media friendly Capital One's spokesman, Adweek reports.

Capital One svp/brand marketing Marc Mentry said: "I think he's going to [join Twitter] as a part of this. We hope he's pretty out and proud in terms of what he's doing."

Barkley has been pretty out in the out and proud about his thoughts on Twitter, though. He posted a video on his personal website in October 2011 that ranted:

"Tweet is for losers. And what I mean by that, if you wake up in the morning and you're worried about what I'm doing, you a damn idiot. You are a damn idiot. I don't feel the need to put every thought that comes in my head out to the world. I don't feel that. And I hope nobody wakes up in the morning and says let me follow Charles Barkley for the day."

But Barkley has done crazier things for brands in the past. He put on a dress for Weight Watchers, after all. (He also got a lot of slack for accidentally calling the Weight Watchers spokesman gig a "scam" live on TNT ? a comment which he later tried to clarify.)

Capital One would be smart to get the huge personality on Twitter and actively discussing the company. Social media is a crucial part of marketing campaigns, after all.

Mentry told Adweek,?"We see digital as the next front where we need to engage consumers very specifically around things like March Madness."

Let's see if Barkley's Twitter sticks.

The study is supported by a massive database from urban areas in the Community of Madrid.

The World Health Organisation has stated that almost 2.5 million people die every year from causes directly attributable to air pollution. In spite of efforts in recent years, toxic nitrogen oxides are one of the main problems of pollution in large cities, where more than half of the world's population lives, some 3,300 million people.

Consequently, much research is carried out on models to predict these chemical compounds, although the majority has failed to consider space-time factors. Researchers from the University of Castilla-La Mancha (UCLM) have designed a geostatistical measurement method called functional kriging, which considers these two variables when estimating environmental pollution.

"Modelling in space is very complicated, as there are infinite directions and everything depends on multiple factors in any direction. Our system, which is a geostatistical model applicable to other questions, such as the rise and fall in house prices, allows us to predict for example the level of contamination there will be tomorrow at the Cuatro Caminos crossroads in Madrid at 8 am", as explained to SINC by Jose Mara Montero Lorenzo, the chief researcher for the study at the UCLM.

The scientists decided to test this statistical model in the capital city because it has 27 pollution monitoring stations, making it one of the cities in the world with the highest ratio of monitoring stations per inhabitant and square kilometre. "To give you an idea of the magnitude, the environmental district of California works with twelve monitoring stations", notes Montero.

Reliability of the system

Pollution has spatial dependencies, such as air currents, the design of the cities, etc. Moreover, it also depends on time what might be a peak in one area will have changed within a few hours. "Even with a supercomputer, it is complicated to design space-time modelling that considers all these variables", explains the researcher.

This is why the alternative of the functional kriging has been put forward. To explain this, as there are 27 monitoring stations and thousands of time instants such that a supercomputer cannot cope with so much data, researchers have represented these by a function and have modelled the time relations of these functions. "It works perfectly", they add.

One of the complaints received from environmental groups in recent years is that the equipment that measures pollution in the cities is not mounted in the places where the true pollution should be measured.

Design

An observation network has been set up for the optimum design of these monitoring stations. According to Montero, "it is possible that although on paper a station should be mounted in a particular place, the installation is not in fact permitted. This problem disappears with our system as we are able to map all of Madrid with true data. This means that if you stand on a flagstone in the street, we can tell you the level of nitrogen dioxide in this zone".

The functional kriging system is supported by a massive database which has measured every hour of pollution from 2001 until 2010 in the different municipalities of Madrid.

"The thesis on which this study was developed won the Economy Award from the Community of Madrid in 2010 and we have received calls from a number of research centres around the world, enquiring about the method. However, no-one has called us back about setting up the system in Spain", concludes Montero.

Over the 6th and 7th of February 2013 1,122 members of the goo Research monitor group completed a private internet-based questionnaire. 60.1% of the sample were female, 10.2% in their teens, 16.6% in their twenties, 26.5% in their thirties, 25.0% in their forties, 11.1% in their fifties, and 10.6% aged sixty or older. Note that the score in the results refers to the relative number of votes for each option, not a percentage of the total sample.

My place of work tries to avoid most of the wastes below, but one thing I notice in the office but not listed here is a bilingual poster that is in all the toilet cubicles that reads something like ?Please close the toilet seat after use. This saves 15 grammes of CO2 per day.? 15 grammes of CO2 is a bit difficult to picture, but apparently is about the same as boiling a kettle, according to Google. WASHINGTON (AP) ? Federal regulators are pressing the Supreme Court to stop big pharmaceutical corporations from paying generic drug competitors to delay releasing their cheaper versions of brand-name drugs. They argue these deals deny American consumers, usually for years, steep price declines that can top 90 percent.

The Obama administration, backed by consumer groups and the American Medical Association, says these so-called "pay for delay" deals profit the drug companies but harm consumers by adding 3.5 billion annually to their drug bills.

But the pharmaceutical companies counter that they need to preserve longer the billions of dollars in revenue from their patented products in order to recover the billions they spend developing new drugs. And both the large companies and the generic makers say the marketing of generics often is hastened by these deals.

The justices will hear the argument Monday.

Such pay-for-delay deals arise when generic companies file a challenge at the Food and Drug Administration to the patents that give brand-name drugs a 20-year monopoly. The generic drugmakers aim to prove the patent is flawed or otherwise invalid, so they can launch a generic version well before the patent ends.

Brand-name drugmakers then usually sue the generic companies, which sets up what could be years of expensive litigation. When the two sides aren't certain who will win, they often reach a compromise deal that allows the generic company to sell its cheaper copycat drug in a few years ? but years before the drug's patent would expire. Often, that settlement comes with a sizeable payment from the brand-name company to the generic drugmaker.

Numerous brand-name and generic drugmakers and their respective trade groups say the settlements protect their interests but also benefit consumers by bringing inexpensive copycat medicines to market years earlier than they would arrive in any case generic drugmakers took to trial and lost. But federal officials counter that such deals add billions to the drug bills of American patients and taxpayers, compared to what would happen if the generic companies won the lawsuits and could begin marketing right away.

A study by RBC Capital Markets Corp. of 371 cases during 2000-2009 found brand-name companies won 89 at trial compared to 82 won by generic drugmakers. Another 175 ended in settlement deals, and 25 were dropped.

Generic drugs account for about 80 percent of all American prescriptions for medicines and vaccines, but a far smaller percentage of the $325 billion spent by U.S. consumers on drugs each year. Generics saved American patients, taxpayers and the healthcare system an estimated $193 billion in 2011 alone, according to health data firm IMS Health.

But government officials believe the number of potentially anticompetitive patent settlements is increasing. Pay-for-delay deals increased from 28 to 40 in just the last two fiscal years and the deals in fiscal 2012 covered 31 brand-name pharmaceuticals, Federal Trade Commission officials said. Those had combined annual U.S. sales of more than $8.3 billion.

The Obama administration argues the agreements are illegal if they're based solely on keeping the generic drug off the market. Solicitor General Donald Verrilli, speaking at Georgetown Law School recently, noted that once a generic drug gets on the market and competes with a brand-name drug, "the price drops 85 percent." That quickly decimates sales of the brand-name medicine.

"These agreements should actually be considered presumptively unlawful because of the potential effects on consumers," Verrilli said.

In the case before the court, Brussels, Belgium-based Solvay ? now part of a new company called AbbVie Inc. ? reached a deal with generic drugmaker Watson Pharmaceuticals allowing it to launch a cheaper version of Solvay's male hormone drug AndroGel in August 2015. Solvay agreed to pay Watson an estimated $19 million-$30 million annually, government officials said. The patent runs until August 2020. Watson, now called Actavis Inc., agreed to also help sell the brand-name version, AndroGel.

Actavis spokesman David Belian disputed the government's characterization of the agreement with Solvay. Belian said that in addition to licensing agreement over Solvay's Androgel patents, Watson was being compensated for using its sales force to promote Androgel to doctors.

AndroGel, which brought in $1.2 billion last year for AbbVie, is a gel applied to the skin daily to treat low testosterone in men. Low testosterone can affect sex drive, energy level, mood, muscle mass and bone strength.

The FTC called the deal anticompetitive and sued Actavis.

The 11th U.S. Circuit Court of Appeals in Atlanta rejected the government's objections, and the FTC appealed to the Supreme Court.

The federal district and appellate courts both ruled against the government, AbbVie, which is based in North Chicago, Ill., said. "We are confident that these decisions will be upheld by the Supreme Court."

The Generic Pharmaceutical Association's head, Ralph Neas, said the settlements are "pro-consumer, pro-competition and transparent." He said every patent settlement to date has brought a generic drug to market before the relevant patent ended, with two-thirds of the new generic drugs launched in 2010 and 2011 hitting the market early due to a settlement.

"By doing what the FTC wants, you're going to hurt consumers rather than help them," said Paul Bisaro, CEO of Actavis of Parsippany, N.J.

Bisaro said consumers will save an estimated $50 billion just from patent settlements involving Lipitor, the cholesterol-lowering drug made by Pfizer Inc. of New York that reigned for nearly a decade as the world's top-selling drug.

Lipitor's patent ran until 2017, but multiple generic companies challenged it. Pfizer reached a settlement that enabled Actavis and a second company to sell slightly cheaper generic versions starting Nov. 30, 2011 and several other generic drugmakers to begin selling generic Lipitor six months later. The price then plummeted from Pfizer's $375 to $530 for a three-month supply, depending on dosage, to $20 to $40 for generic versions.

Because generic companies tend to challenge patents of every successful drug, the FTC's position would impose onerous legal costs on brand-name drugmakers and limit their ability to fund expensive research to create new drugs, said the Pharmaceutical Research and Manufacturers of America, which represents brand-name drugmakers.

According to the 2010 RBC Capital Markets study, when trial victories, settlements between drugmakers and dropped cases are combined, generic companies were able to bring their product to market before the brand-name drug's patent expired in 76 percent of the 371 drug patent suits decided from 2000 through 2009.

Consumer, doctor and drugstore groups have lined up to support the Obama administration in this case.

"AARP believes it is in the interest of those fifty and older, and indeed the public at large, to hasten the entry of generic prescription drugs to the marketplace," said Ken Zeller, senior attorney with the AARP Foundation Litigation. "Pay-for-delay agreements such as those at issue in this case frustrate that public interest."

The American Medical Association, the giant doctors' group, believes pay-for-delay agreements undermine the balance between spurring innovation through patents and fostering competition through generics, AMA President Dr. Jeremy A., Lazarus said. "Pay for delay must stop to ensure the most cost-effective treatment options are available to patients."

Drugstores also believe pay-for-delay deals "pose considerable harm to patients because they postpone the availability of generic drugs which limits patient access to generic medications," said Chrissy Kopple of the National Association of Chain Drug Stores.

Eight justices will decide this case later this year. Justice Samuel Alito did not take part in considering whether to take this case and is not expected to take part in arguments.
