Google dropping ActiveSync support for Gmail, forcing new connection to go through their shoddy IMAP service

As part of their "Winter Cleanup", Google announced today that they'll be deprecating support for Gmail, Google Calendar, and Google Contacts over Exchange ActiveSync, or GoogleSync as they call it. According to Google:

Google Sync was designed to allow access to Google Mail, Calendar and Contacts via the Microsoft Exchange ActiveSync? protocol. With the recent launch of CardDAV, Google now offers similar access via IMAP, CalDAV and CardDAV, making it possible to build a seamless sync experience using open protocols. Starting January 30, 2013, consumers won't be able to set up new devices using Google Sync; however, existing Google Sync connections will continue to function. Google Sync will continue to be fully supported for Google Apps for Business, Government and Education. Users of those products are unaffected by this announcement.

Apple led the development of the open source CalDAV and CardDAV protocols, expressly to be alternatives to Microsoft's Exchange dominance. I don't sync Google Contacts, or use them at all because I've historically found them to be both overly promiscuous (they continually fill with junk I didn't explicitly add) and unreliable. I do sync Gmail and Google Calendar, however, and so I'm not looking forward to not being able to add them via ActiveSync on future devices.

That's entirely because Google's IMAP service has always been shoddy. It throws up "exceeded bandwidth" and "too many simultaneous connection" errors that are downright embarrassing coming from the world's largest Internet company.

I have both a Google Apps account for work, and a Gmail account for personal use, so it looks like I'll get to keep EAS support on one of them but not the other, which creates a very inconsistent user experience.

I love the new Gmail app, but I prefer having all my email in one, unified app. I want to see everything in my inbox all at once. And as a user, I shouldn't have to care which pipe my communications are coming through, they should just show up in my interface. Having to go to separate app just for Gmail breaks that experience as well.

Overall, this feels like Apple ditching Google data from iOS 6 Maps, but at an even more problematic level: Microsoft can't just release an app of their own to fix it.

Texas Workers' Compensation Opt-Out Report: A Herculean Effort ...

Unlike any other US state, Texas has never required its employers to buy or provide statutory workers' compensation. Texas employers who opt-out of this traditional form of injury benefit system are called non-subscribers. In 1993, 44% of Texas employers were non-subscribers, and they employed 20% of the employees in the state. By 2008, employer non-subscribers had shrunk to 33%, but their percentage of the state's total workers had grown to 25%. No one knows for sure, but estimates are that as many as 114,000 Texas employers have opted-out.

Until now, with the exception of two academic studies, one in 1996 examining lost injury days, the other, a 2010 survey of large, multi-state non-subscribers, no one has ever fully examined the Texas opt-out phenomenon. But, with the release today of the 87-page "Workers' Compensation Opt-Out: Can Privatization Work? The Texas Experience and the Oklahoma Proposal," that has changed.

Funded by the big TPA, Sedgwick CMS, published by the New Street Group and written by Primary Researcher Peter Rousmaniere and former Risk & Insurance editor and New Street Group founder Jack Roberts, this thorough, well-researched and entirely lucid analysis is certain to propel the opt-out debate now and in the foreseeable future.

In Texas, It's 1910 All Over Again
To get a grasp of the back-to-the-future Texas opt-out, think 1910, the year before states began enacting workers' compensation laws, the grand bargain in which employers promised to replace lost wages and cover medical costs due to injury and workers agreed not to sue employers when the workers were injured on the job.

Lots of employers buy workers' comp in Texas, but for those who don't it's 1910 all over again with virtually no state oversight. Let me be clear about that: In Texas, there is no requirement for non-subscribers to pay for work injuries in any way. There is one important difference, however. The Texas legislature has statutorily removed the three major defenses used by employers prior to workers' comp statutes being enacted to defend themselves against worker suits: contributory negligence, assumption of risk and the negligence of fellow employees. Also, without workers' comp, there can be no "exclusive remedy," and for non-subscribers there isn't. Large non-subscribers, such as Costco, have been very creative in dealing with that.

Rousmaniere and Roberts discovered that Texas opt-out was a bit of a carnival sideshow until ten to fifteen years ago when large employers like Costco, whose program they analyze in depth, cottoned on to the idea that they could provide a sleek, fast-moving, common-sensible injury benefit management system if they wove it into their ERISA plans. ERISA, the Employee Retirement Income Security Act, is a federal program which allows employers to design their own benefit systems, and substantially more than a cottage industry has evolved in Texas to help them do that for worker injuries. The operable phrase in that last sentence is "design their own."

Designing Their Own
Suppose someone, your boss for example, said to you, "There's no more workers' comp. Design me a plan that will provide our workers who get injured immediate medical care and wage replacement. Make worker participation mandatory. Keep the administration to nothing more than what is absolutely needed for it to run smoothly, and, before I forget, keep all the lawyers out of it."

What would you do? Well, large employers in Texas have had about fifteen years to think about that, and at least one of them, Costco, has created the ideal program I would design myself if I had a magic wand. I say "at least one," because Costco is the only employer Rousmaniere and Roberts point to, although they do report on interviews with many professionals involved in Texas opt-out. They also suggest that Costco is fairly typical of the large employer opt-out experience.

After much research and planning, Costco became a non-subscriber in 2007. At that time, the company operated 15 large warehouses throughout Texas, carried a payroll of $87 million and employed about 4,000 workers. Its loss costs had grown to around $150 per employee, or 97 cents per hundred dollars of payroll. In the four years following non-subscription, losses fell to 46 cents per hundred dollars of payroll, a decline of 52%, with high employee satisfaction for the system.

Here are the main points of Costco's worker injury benefit program, and remember, Costco was able to start with a blank piece of paper:

  • Work must be the "sole cause" of injury, not just a "contributory factor." More about this below.
  • Injuries "must" be reported by end of shift, but in no case later than 24 hours after happening. Failure to do this will negate any benefits. Workers who don't report in time are on their own; most use group health to cover medical costs, but, as one can imagine, a worker is more likely to win the Powerball than to not report within 24 hours.
  • Employees receive a taxable 80% of pre-injury wages with no waiting period. They're paid from day one.
  • Upon hiring, workers are required to accept binding arbitration for disputed claims, and Costco picks the arbitrators. If unsatisfied with the arbitrator's ruling, employees do have the option of bringing suit for employer negligence in civil court, but since 2007 only three such suits have been brought; two were settled modestly, and the third is pending
  • Chiropractic care is not allowed (Costco's analysis of its losses concluded that excessive chiropractic care was a major driver of loss costs and unnecessary for employee recovery)
  • There are no permanent partial disability awards
  • Wage and medical benefits end after 156 weeks, but, in rare cases, future medicals can be settled (Rousmaniere and Roberts don't address this, but I'm wondering about the degree to which CMS plans on extending its long, bony Medicare fingers into this pie)
  • Costco carefully picked an emergency care and specialist medical provider network comprised of highly reputable physicians, with as many as possible being board-certified occupational medical physicians. Costco routinely pays its providers full invoiced charges
  • If employees fail to follow through on medical recommendations or miss appointments for no good reason, benefits are terminated
  • For the rare event when injuries extend beyond 156 weeks, Costco has purchased insurance to cover the tail
  • Because any disputes go quickly to arbitration, attorney involvement is nearly non-existent

With loss costs reduced by 52% and employee satisfaction high, Costco obviously has a winning program. Costco has seamlessly woven injury benefits into its ERISA plan, blending them with its group health and short and long-term disability programs.

One thing that Costco wrestles with is co-morbidity. Imagine a Type-1 diabetic warehouse worker without safety shoes who drops some heavy object on his or her foot. Because of the diabetes, the foot is much more susceptible to infection, which actually happens. Then, because diabetes seriously inhibits healing, the infection worsens, and the foot is amputated. In statutory workers' comp, this would be covered, but what about at Costco. I asked Peter Rousmaniere about this. He wrote back:

"You are right, this would be excluded... With Obamacare assuring universal health coverage, the opt-out employer's message will be something like, "Don't expect indemnity payments for a work injury if there is a good chance that your personal health condition will contribute to it."

Rousmaniere admits that this "sounds draconian," but he believes that this issue, as well as what to do about degenerative conditions, such as what to do about the 55-year old wall board hanger whose rotator cuff finally gives out, will gradually self correct with help from the ADA as well as the Affordable Care Act. The jury on this is decidedly out. But, just for a moment, imagine that he's right. What we could be moving toward, after decades of failed experiments, is the first manageable and potentially successful version of 24-hour care.

The Other Side of the Coin
One thing is clear from the Rousmaniere and Roberts study: Costco and other large employers like Target and Safeway, two other non-subscribers, have the resources and core values necessary to provide compassionate care for injured workers while bringing them back to work as fast as medically possible in a businesslike way. But what about Kenny's CITGO, down the street on the corner with five employees, all of whom, including Kenny, live paycheck to paycheck? And Kenny is just as free to non-subscribe as Costco.

Kenny and others like him are the Third World of non-subscription. Operating with no regulatory or legal oversight by the state, he can do what he pleases or what he perceives he can afford, which is probably not much. If one of his workers is injured, and Kenny decides to offer nothing in the way of injury benefits, the worker is on his own. He can certainly sue Kenny for employer negligence, and Kenny won't have those three pre-workers' comp era defenses to rely on. However, no attorney is going to take the employee's case because Kenny won't have the resources to pay if he loses, which he probably would. But, to quote Rousmaniere and Roberts, "That is a hollow victory, indeed."

And on a grander scale, what about the large employer with significant resources, but who also may have more than a bit of malevolence in its DNA and wants to play schoolyard bully (see Massey Energy)? In an environment without one scintilla of regulation will the bully treat workers fairly?

The Oklahoma Proposal
After studying the lay of the land for the Texas opt-out and seeing where the Punji Pits are (see Kenny's CITGO and Massey Energy), Oklahoma legislators crafted a remarkable piece of opt-out legislation that narrowly lost 42 to 50 in the Oklahoma House of Representatives in late April, 2012.

The Oklahoma proposed legislation would have corrected many of the perceived flaws in the Texas opt-out system. For example, Oklahoma would require any employer choosing to opt-out to provide similar, in some cases better, benefits than the statutory system. Also, injury benefits would be required to be part of an ERISA-approved plan, although there is significant uncertainty if this provision would withstand a constitutionality challenge. Further, employers applying to opt-out would have to pay a fee of $1,500 annually to do so. This would more than likely eliminate the Kennys of the world, employers who just don't have the resources to "pay to play."

Rousmaniere and Roberts expect Oklahoma legislators to do some tinkering and re-file during 2013. They think there is a good chance that this time the legislation will pass. Whether Governor Mary Fallin, who campaigned on a platform of workers' comp reforms, will sign it is another matter.

Summary
This 87-page report is a Herculean effort, and, in my view, the worker's compensation insurance industry owes Rousmaniere and Roberts a huge debt for spending close to a year to produce it. Sedgwick should be commended for funding it. Perhaps we can forgive Rousmaniere for a bit of acquired bias, but he's seen, up close, what a conscientious, fair-minded employer can do if given the chance. I come away from his report finding myself agreeing with him as he wrote me the other day: "Every state should offer and every medium and large sized employer should consider opt -out." But to this I add, "With a healthy dose of regulatory and state oversight. Not everyone is Costco."

Vilma urges rejection of Goodell motion to dismiss

NEW ORLEANS (AP) ? Jon Vilma urged a federal judge Friday to reject NFL Commissioner Roger Goodell's motion to dismiss the defamation lawsuit filed against him by the Saints linebacker.

Vilma's request to U.S. District Judge Ginger Berrigan argues Goodell acted with "reckless disregard for the truth" when basing initial allegations about Vilma upon one fired Saints assistant, Mike Cerullo, whose testimony has been inconsistent and challenged by other witnesses in the NFL's bounty probe of the Saints.

The motion centers on Goodell's public comments that Vilma held up $10,000 cash in a team meeting in 2010, offering it to anyone who knocked Arizona quarterback Kurt Warner out of a playoff game.

During recent NFL appeal hearings in the bounty case, former Saints defensive coordinator Gregg Williams testified he never saw any money.

"Williams has always told Goodell, and continues to state, that there was never any cash put up for a bounty on any player. It was 'just talk.'" Vilma's motion reads. "Nonetheless, Goodell irresponsibly chose to contend that Vilma walked around with $10,000 before the Cardinals game."

Vilma's season-long suspension and with various shorter bans for three other players were thrown out Tuesday by former Commissioner Paul Tagliabue, who Goodell had appointed to oversee the appeals of player punishment.

After Tagliabue's decision, the NFL Players Association dropped claims in federal court on behalf of Saints defensive end Will Smith and two former Saints: Cleveland linebacker Scott Fujita and free agent defensive lineman Anthony Hargrove. Vilma dropped his claims against the league concerning the disciplinary process, but moved forward with his defamation case against the commissioner, asking Berrigan to allow discovery, which consists of the collection of evidence and deposing of witnesses. Berrigan has so far delayed discovery while the Goodell's motion to dismiss the case is pending.

In their effort to highlight how unreliable Cerullo was, Vilma's attorneys, Peter Ginsberg and Duke Williams, cite hearing testimony from Saints assistant head coach Joe Vitt, who said Payton once arranged for police protection at his former suburban family home while he was away at league meetings because the head coach feared Cerullo was emotionally unstable and might harm his family.

While the lawsuit does not quote the testimony from the closed-door hearing directly, it appears in transcripts obtained by The Associated Press.

"An email was sent to the League about Mike Cerullo long before these (bounty) charges were brought up on our football team saying that Mike Cerullo was crazy, that Sean Payton had to have a police escort or, excuse me, police protection at his house because he was going to the owners' meeting, and he was worried about his family with Cerullo," Vitt testified. "This is the kind of guy we're dealing with. Allright?"

Vilma's motion also notes that the NFL subsequently dropped Goodell's initial allegation about Vilma physically holding up money in the meeting before the Arizona game.

"There can no longer be any doubt that Goodell acted with malice ... in making this quasi-criminal accusation against Vilma," the motion said.

The NFL continues to allege that Vilma offered a $10,000 to anyone who knocked then-Minnesota quarterback Brett Favre out of the 2010 NFC title game, which followed the Arizona game. Williams testified that he recalled such an offer for that game, but never saw any money change hands and suggested the offer represented nothing more than tough talk in an emotional meeting that he allowed to get out of hand.

A federal program is offering grants and low-interest loans for low-income homeowners to repair and improve their homes.

The U.S. Agriculture Department?s Rural Development program offers loans of up to $20,000 to improve or modernize homes, according to a news release. Eligible repairs include roofing, siding, windows, septic system and furnace or air conditioning. Applicants should own the home, have acceptable credit and meet very low income guidelines.

Grants also are available to homeowners who meet very low income guidelines, are 62 years old or older and show they cannot repay the loan. Grant money of up to $7,500 can be used to address health, safety or accessibility issues for the home, the news release states.

Weaver cost himself big bucks

Zack Greinke?s new six-year, $147 million contract with the Dodgers got me wondering just how much money Jered Weaver gave up by signing an extension with the Angels rather than hitting the open market alongside Greinke this offseason.

Now that Greinke has signed we can get a clearer picture of just how much money Weaver left on that table.

Greinke is 29 years old with a 3.77 ERA in 1,492 career innings, including a 3.83 ERA in 604 innings during the past three seasons. Weaver is 30 years old with a 3.24 ERA in 1,320 career innings, including a 2.73 ERA in 649 innings during the past three seasons.

It seems hard to argue that Weaver isn?t as good as Greinke and there?s certainly an argument to be made that he?s better. And yet Greinke will be getting $147 million over the next six seasons while Weaver will be paid $70 million over the next four seasons. If healthy Weaver will close some of that gap with his next contract that covers Season 6 and Season 7, but it sure looks like he cost himself at least $40-$50 million by not testing free agency.

Celebrates Ribbon Cutting For New $1.5M School | Osprey Observer

Students, teachers and some 80 special guests have gathered in a brand new ?cafetorium? for plaques and presentations, as well as a ribbon cutting last month on what school officials called a gleaming new 12,000 sq. ft. charter school in Ruskin.

The celebration at Redlands Christian Migrant Association (RCMA) Leadership Academy located off U.S. 301, on the campus of Beth-El Mission, at 18234 U.S. Highway 301 South in Wimauma, marked the end of a fundraising campaign that began in 2008, a construction project that began in March and final touches on a cafeteria and auditorium that opened just one week prior.

School officials proudly emphasized that collectively the festivities? honored guests generated more than $1.5 million in donations for the project.

According to RCMA Director of Communications and Marketing Bill Coats, opening this fall Leadership Academy, currently cares for 52 students in grades six and seven, but at capacity, will serve 132 students in grades 6-8.

?It is a sibling to the 12-year-old RCMA Wimauma Academy, an elementary school next door,? Coats said. It was created to provide high-quality education customized to the bi-cultural lives of south Hillsborough County?s low-income families are extensions of RCMA?s larger role of early childhood education for Florida?s rural poor that runs 18 child care centers in the Tampa Bay area and 71 statewide.

RCMA Leadership Academy now boasts eight classrooms, a 900 sq. ft. area for administrative offices, the cafeteria and auditorium.

Honorees included Gary Wishnatzki, an RCMA board member and owner of Plant City-based Wish Farms, which along with an annual tennis tournament, accounted for more than $330,000 in donations to the Leadership Academy building campaign.

In Wishnatzki?s honor, the school named the cafeteria bearing his family name as well as planted a live oak on the grounds and mounted a painting of strawberry pickers in the office.

Also on the roster of honored guests was Tampa businessman John Kirtley, founder of Step Up For Students and leader of Florida?s movement for parental choice in schools.

Kirtley personally donated $100,000, while Step Up for Students matched that amount.

?A live oak was also planted in front of the school in honor of Kirtley and his family,? Coats said.

Also honored were two local groups that contributed more than $50,000 apiece: the Interfaith Council of Sun City Center and the Community Foundation of Greater Sun City Center.

?Building this school was like giving birth,? said Mainster. ?Once it was done, we could forget all the pain.?

Ariz. home: 'Ditto' to neighbor's Christmas lights

MARICOPA, Ariz. (AP) ? An Arizona woman who knew she couldn't compete head on with her neighbor's elaborate Christmas light display is attracting attention for her response.

Using red and green lights, Kristina Green of Maricopa spelled out the word "ditto" and made an arrow pointing toward her neighbor's home.

KNXV-TV reports (http://bit.ly/Uv8Qz9) that Green's display is made of around 600 lights. Her neighbor's set-up has about 16,000 colorful lights.

Green has created a Facebook page for her "ditto" sign.

Last year, a family in Beaverton, Ore., also erected the word "Ditto" with an arrow on the side of their own home toward a neighbor's house as part of an online movement.

Bahrain opposition hails crown prince's call for talks

MANAMA (Reuters) - Bahrain opposition groups welcomed a government appeal for dialogue to break a deadlock in the restive kingdom, saying they were prepared to meet without any pre-conditions, but called for the results of talks to be put to a referendum.

The Gulf Arab state, which hosts the U.S. Fifth Fleet, has been convulsed by unrest since February last year following mass demonstrations led by majority Shi'ites demanding democratic change in the Sunni-led monarchy.

The ruling Al Khalifa family brought in Gulf Arab troops, mainly from Saudi Arabia, and imposed over two months of martial law to end the uprising. Small-scale clashes between police and protesters now happen almost daily.

Prince Salman bin Hamad bin Issa al-Khalifah told a conference on Middle East security in Manama on Friday that real progress can only come through face-to-face negotiations.

Wefaq, the leading opposition group in Bahrain, said in a statement it was willing to take part in talks but the outcome should "be approved by the people".

The group's leader Sheikh Ali Salman told Reuters he would push for a referendum, an idea first aired before a failed attempt at dialogue last year. But he said a referendum was a not a condition of starting talks.

"We have clear opinion about that. We are looking for a dialogue without any precondition and it is the same for the government - don't put any precondition," he said in an interview in Manama.

Bahrain, where the Fifth Fleet is based as a bulwark against Iran, accuses Tehran of encouraging the unrest. Iran, which is led by Shi'ite clerics, has denied meddling in Bahrain's affairs.

Some Sunni Bahrainis argue against democracy in the kingdom citing what they describe as the influence of Iran's Shi'ite clerics over Bahrain's Shi'ite majority.

"People vote for religious figures. Their mentality is to follow the religious leader," said a prominent Bahraini Twitter user who styles himself Ateekster and asked for his real name not to be used in a phone interview.

Pro-government members of parliament and advisers to the authorities have complained that it is not clear whether Wefaq could speak for the whole opposition and that it has shifted position before on possible talks.

Other groups, including the secular Waad, also welcomed the call for new dialogue.

In his speech on Friday, Crown Prince Salman urged all political figures to condemn street violence.

King Hamad last year called for talks "without preconditions", but that initiative quickly stalled when Wefaq pulled out, saying its views were not being taken seriously.

Salman said he had been indirectly contacted by the authorities but did not have any information on when talks would take place.

The two sides have appeared to softened their positions in recent days. In his speech the crown prince said Bahrain needed to work harder on judicial reform and to ensure policing was equally applied to all Bahrainis.

On Friday Wefaq's leader chastised protesters chanting slogans directly attacking the king and ruling family.

The authorities have banned protests, saying they often lead to confrontations that block the streets, and revoked the nationality of 31 activists. Opposition groups say brutality and repression used to put down last year's revolt, which embarrassed Bahrain's Western allies, continues.

"We demand that the authorities stop using excessive and systematic force against citizens," the opposition statement said.

(AP) ? The factory where 112 garment workers died in a fire should have been shut down months ago. The fire department refused to renew the certification it needed to operate, a top fire official told The Associated Press. And its owner told AP that just three of the factory's eight floors were legal. He was building a ninth.

Government officials knew of the problems, but the factory just kept running.

The Capital Development Authority could have fined Tazreen Fashions Ltd. or even pushed for the demolition of illegally built portions of the building, said an agency official, who spoke to The Associated Press on condition of anonymity because he was not authorized to talk to the media. But it chose to do nothing, rather than confront one of Bangladesh's most powerful industries, he said.

"I must say we have our weaknesses. We could not do that," he said. "Not only Tazreen. There are hundreds more buildings. That's the truth."

Bangladesh's $20 billion-a-year garment industry, which accounts for 80 percent of Bangladesh's total export earnings, goes virtually unchallenged by the government, said Kalpona Akter, executive director of the Bangladesh Center for Worker Solidarity, a labor rights group.

"These factories should be shut down, but who will do that?" she said. "Any good government inspector who wants to act tough against such rogue factories would be removed from office. Who will take that risk?"

Fire officials did challenge the factory, though they appeared reluctant to go too far.

When the factory's fire safety certification expired June 30, Dhaka's fire authorities refused to renew it, a fire official told the AP, speaking on condition of anonymity because he was not authorized to speak to the media.

A factory must be certified to operate, but the department usually gives factory owners some time to upgrade conditions. If they fail to do so, the department can file a court case to get it closed down. But it rarely does, and did not in Tazreen's case.

"These factories should be closed, but it is not an easy task," the fire official said. "We need to follow a protracted legal battle. Always there is pressure because the owners are influential. They can manage everything."

The Nov. 24 fire tore through the ground floor of the behemoth white, concrete factory, which fills most of a block in the Dhaka suburb of Savar. About 1,400 employees were cutting fabric and sewing clothes for Wal-Mart, Disney and other Western brands.

Dipa Akter had no idea she was in any danger during the three years she worked at the Tazreen factory.

"We never thought such a big fire could happen at Tazreen. We thought there would be no problem if there was a fire. There are three stairways ... we never thought our colleagues would die this way," she said.

Now, the factory stands gutted, its cavernous floors littered with burned clothes, yarn, machinery and furniture. Glass from windows broken by desperate workers who tried to jump to safety is scattered along with black ash on the floors and staircases.

Though the factory had three staircases, it had no specially designed emergency exits. Fire extinguishers in the building either didn't work or workers didn't know how to use them, survivors said.

The fire official declined to provide specifics about what violations the department had uncovered in the months before the fire.

"I can't explain more because the case is very sensitive and this is under investigation," the official said.

The chairman of the Capital Development Authority, Nurul Huda, did not return calls seeking comment.

Tazreen's owner, Delwar Hossain, said the government granted him authorization to construct a three-story factory. Nonetheless, he added five more floors and was constructing a ninth when the blaze broke out, he said late Thursday.

The construction is in direct violation of a law that requires advance written approval of factory construction and expansion.

When asked why he went ahead with the expansion anyway, he responded: "My mental condition is not good. I am under pressure. Please don't ask me anything else."

Hossain is a former accounts manager at a garment factory who started his own company, Tuba Textiles Mills Ltd., in 2004 and now has a dozen factories of his own.

Other factory owners hold parliamentary posts and other prestigious positions. In one sign of the industry's power, the government has dispatched a special police force just to maintain order in the factories.

The risky conditions at the Tazreen plant were known not only to government officials, but to major U.S. retailers whose products were made there.

Wal-Mart audited Tazreen in 2011, giving it an "orange" or high-risk rating. Months later it did a second audit, and early this year the factory was no longer authorized to produce merchandise for the retail giant. However, an AP reporter who visited the factory last week found Wal-Mart brands were still being made there. The company said a supplier ? who has since been fired ? had moved Wal-Mart production there without its knowledge.

Akter, the rights activist, estimates that more than half the nation's more than 4,000 garment factories have safety arrangements only on paper.

Factory owners "are very powerful, or backed by powerful associations and people," Akter said. She added that many inspectors are bribed to ignore violations.

In the two weeks since the blaze, the fire department has inspected 232 factories in the industrial area where Tazreen was located. It found that more than one-quarter of them ? 64 ? lacked fire safety licenses or safety measures such as fire extinguishers, water reservoirs and workers trained to fight a fire, said Dhaka fire chief M. Abdus Salam.

Those 64 factories will be shut down if they fail to address the issues within a month, Salam said.

In the meantime, they continue producing clothes.
